Welcome to Michael Sydney.

The terms “we”, “us” and “our” refer to RLR Ventures LLC, operating the online store Michael Sydney.

Michael Sydney operates this store and website, including the related information, content, features, tools, products and services offered to you (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

SECTION 3: ORDERS

When you place an order through Michael Sydney, you are submitting an offer to purchase the selected products.

An order is considered accepted once we have confirmed the order and successfully processed the applicable payment.

We reserve the right to refuse, limit or cancel an order where permitted by applicable law, including in cases involving suspected fraud, payment issues, inventory errors or other legitimate operational reasons.

If we make a material change to or cancel an order, we will make reasonable efforts to contact you using the email address, telephone number or billing information provided with your order.

Please review your order carefully before completing your purchase. Once an order has entered processing or fulfilment, we may not be able to cancel or modify it.

Returns and refunds are governed by our Return & Refund Policy, subject at all times to rights and remedies that cannot be excluded under the Australian Consumer Law and other applicable law.

Products purchased from Michael Sydney are intended for personal or household use unless otherwise agreed.

Prices, discounts, promotional offers and product availability may change without prior notice.

The price applicable to your purchase will be the price shown when your order is placed, subject to applicable law.

Unless expressly authorized by us or permitted by applicable law, you may not reproduce, distribute, modify, publish, display, sell, license, download or otherwise exploit our content.

The name Michael Sydney, associated branding, logos, designs and slogans may not be used without prior authorization where they are protected by applicable intellectual property rights.

Shopify and other third-party names, logos and trademarks remain the property of their respective owners.

We may provide access to tools, features or services operated by third parties.

We do not necessarily monitor or control these third-party tools.

SECTION 9: RELATIONSHIP WITH SHOPIFY

Michael Sydney is powered by Shopify.

Shopify provides technology and infrastructure that enables us to operate our online store.

However, purchases made through Michael Sydney are transactions between you and RLR Ventures LLC, operating as Michael Sydney.

To the extent permitted by applicable law, Shopify is not the seller of products purchased from Michael Sydney and is not responsible for fulfilling your order or handling obligations arising directly from the sale between you and us.

SECTION 10: PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable privacy laws.

Because our Services use Shopify and other service providers, certain personal information may be processed by Shopify or other third parties that provide services necessary to operate our store.

In particular, goods supplied to consumers in Australia come with consumer guarantees under the Australian Consumer Law, including guarantees relating to acceptable quality, fitness for disclosed purpose and correspondence with description where applicable.

These statutory consumer guarantees operate independently of any voluntary warranty or return policy offered by us.

To the extent permitted by applicable law, you agree to indemnify and hold harmless RLR Ventures LLC, Michael Sydney and our affiliates, officers, directors, employees, contractors, agents, licensors and service providers from third-party claims, liabilities, damages and reasonable legal expenses arising directly from:

  2. your violation of applicable law;

  3. your infringement of another person's rights; or

  4. your unlawful use of the Services.

This section applies only to the extent permitted by applicable law and does not limit any non-excludable consumer rights.

SECTION 18: SEVERABILITY

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.

The remaining provisions will continue in full force and effect.

However, nothing in these Terms is intended to exclude, restrict or modify rights or remedies available to consumers under the Australian Consumer Law or any other mandatory law that applies to the transaction.

Where applicable law grants you the right to bring a proceeding or make a claim in another jurisdiction, nothing in this section is intended to restrict a right that cannot lawfully be restricted.

The headings contained in these Terms are included for convenience only and do not affect the interpretation of the provisions.

Where required by applicable law, we will provide notice of material changes.

Your continued use of the Services following an effective update constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Nothing in this section permits us to retrospectively remove or limit rights that have already arisen under applicable law.
